When you are acting as
plaintiff’s counsel in a medical malpractice
case, one of the grounds of liability you may
want to investigate is a possible breach of the
duty to diagnose, and the companion duty to
refer, by the attending physician(s). The legal
principles governing these duties are now well
defined, and seemingly cast a broad net for
potential liability.
